Damage Caused By Burglar Denied As Normal Wear And Tear


 

 

The three attached pictures are of damages caused by a burglar.  The first two photos are of wall corners and the last of a Formica countertop.  As the burglars carried armfuls of items from the home they were not exactly careful with what they were bumping into - or dropping onto the flooring.  Most of the damages caused were in areas of the home that commonly experience the most foot traffic such as down hallways through the middle of the kitchen towards the rear door etc.  
 
The insurer is attempting to make the victim feel like they are to blame for the damages because these types of damages do frequently happen in high traffic areas of homes due to normal wear.  However the victim has stated that these areas were not damaged prior to the burglary.

The policyholder is the only witness. If they swear that it was not like that before then the insurer should pay it unless they have proof to the contrary.
The insurance carrier should not pay. Burglars are always careful - they never damage things - that would be wrong!
The insurance adjuster should deny payment. Who will believe the home owner? These types of damages are common in homes.
The adjuster should pay but only minimum charges that add up to just under the deductible. No Claim!
The owner should have taken pictures of every surface in every room every day. No proof - claim denied sucker!
